But the last execution took place more than a decade ago.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">State Senator Tick Segerblom wants to end the practice all together. He, with Assemblyman James Ohrenschall, is proposing a bill that would make the state's maximum punishment life in prison without parole.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"I don't think a society has the right to decide who is going to live or die," Segerblom said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Besides the moral argument against the death penalty, Segerblom said money is also a factor. He said the state spends millions of dollars on death penalty cases, but no one is executed.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"It's really just a feel good issue for people to say 'We're going to kill someone because they did something bad,' but at the end of the day, we never do kill the person and we spend millions of dollars trying to get to the point where we could kill them but it never happens."</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Besides the state and federal appeals that take up both time and money, the drugs to execute people are not available. Segerblom said the state spends millions of dollars to get prisons to the point where they can be executed but it is never going to happen.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Tod Story with the American Civil Liberties Union of Nevada agreed that the money spent on death penalty cases is far more than putting a prisoner away for life.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">According to the Las Vegas Review-Journal, a state audit of the cost of death row versus life in prison showed it costs sometimes double for someone to be sentenced to death than to be sentenced to life in prison without parole.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Story said the argument against the death penalty goes beyond just the cost. He believes it is fundamentally about the society we want to be.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"I think the fundamental question comes down to whether we as a government, we as a people, we as a society, can take away someone's life," he said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Supporters of the death penalty have said that it is a deterrent, arguing that people won't do something if they know they could face the death penalty for it.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">For instance, Illinois is 1 of 18 states that has repealed its death penalty and the murder rate in Chicago has skyrocketed lately.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Both Story and Segerblom dismiss the argument that having a death penalty does anything to stop crime.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"There is no correlation between whether you have the death penalty, you don't have the death penalty as far as violent crime," Segerblom.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"We still have the death penalty here in Nevada and we had if not the highest, but one of the highest, murder rates here in Las Vegas last year," Story said, "We know that it is not a deterrent."</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Segerblom is purposing the legislation when the Legislature meets in February, but he is not entirely sure it will pass or that the governor will sign it.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"I had a bill a couple of sessions ago just to ask to study the death penalty and the governor vetoed it," he said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Story remains optimistic that Gov. Pakistan: The love of hanging

The resolution adopted on Dec 19, 2016 was backed by 117 states, while 40 voted against it and 31 abstained. As against the voting pattern in 2014, the new supporters of the moratorium call were Guinea, Malawi, Solomon Islands, Sri Lanka and Swaziland.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">South Asia maintained its fondness for the death penalty as Pakistan joined Afghanistan, Bangladesh, India and Maldives in rejecting a universal moratorium, while Bhutan, Nepal and Sri Lanka voted in favour.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Those who defend the death penalty as a principle enjoined by Islam may look at the division among the Muslim states (the category includes all members of the OIC).</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Those voting in favour of a moratorium included: Albania, Algeria, Azerbaijan, Benin, Bosnia Herzegovina, Burkina Faso, Chad, Cote d'Ivoire, Eritrea, Gabon, Guinea, Guinea Bissau, Kazakhstan, Kyrgyzstan, Mali, Mozambique, Sierra Leone, Somalia, Suriname, Togo, Tajikistan, Tunisia, Turkmenistan and Uzbekistan.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Those who abstained included: Bahrain, Cameroon, Comoros, Djibouti, Indonesia, Jordan, Lebanon, Mauritania, Morocco, Niger, Nigeria, Uganda and the UAE.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The Muslim states that voted against were: Afghanistan, Bangladesh, Brunei, Egypt, Guyana, Iran, Iraq, Kuwait, Libya, Malaysia, Maldives, Oman, Pakistan, Qatar, Saudi Arabia, Sudan, Syria and Yemen.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">We find that 24 of the OIC's 57 member states voted in favour of the moratorium, while 13 abstained and only 18 voted against. In other words, Pakistan is in the minority group of 18 OIC member-countries that opposes the moratorium.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">It is for Pakistan's government and its Islamic scholars to ponder as to why a majority of the OIC members do not find any faith-based bar to the acceptance of a moratorium on capital punishment. They may also consider the possibility that, as in the case of some international treaties, reservations expressed in the name of religion are in fact dictated by the culture or custom of the countries concerned.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">What is more distressing for human rights activists, abolitionist groups and promoters of humanitarian laws in Pakistan is the authorities' aversion to any scrutiny of the rationale for their love of the death penalty regime.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">What one hears of references to the death penalty during the Universal Periodic Review or at talks with the European Union on the GSP+ status is not the result of any serious deliberation. Indeed, one doubts if any discussion on the subject has ever taken place in Pakistan. That there is an urgent need for such a discussion can easily be established.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The recent cases in which the Supreme Court acquitted two individuals who had already been executed, or ordered the release of persons who had spent long years on death row, have strengthened the call for abolition of the death penalty on the ground of high risk of miscarriage of justice. A number of other issues that have surfaced over the past many years also need to be addressed. These are:</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">-- The view that the death sentence is not a deterrent to crime has not been challenged nor has the view that hangings brutalise society.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">-- The Qisas law has prevented the president from pardoning death convicts or commuting their sentence although his power to do so under Article 45 of the Constitution remains intact. How does one explain the fact that the army chief can pardon a person awarded the death sentence by a military court while the president cannot do so?</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">-- The scholars agree that Islam prescribes the death penalty in only 2 instances. How does the state defend the fact that capital punishment is prescribed for 27 offences in the name of religion?</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">-- The judiciary has pointed out the problems it faces in cases in which capital punishment is mandatory if the evidence on record warrants a lesser penalty.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">-- The possibility of a minor or a mentally challenged person being executed keeps cropping up every now and then.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">One ventures to suggest a look at the Indian response to the issue of the death penalty in view of the shared legal tradition.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The Law Commission of India recommended in August 2015, vide its Report No. 262, that "the death penalty be abolished for all crimes other than terrorism-related offences and waging war". The commission agreed to retain capital punishment for certain offences in view of the parliamentarians' plea that "abolition of death penalty for terrorism-related offences and waging war will affect national security", although in the commission's view "there is no valid penological justification for treating terrorism differently from other crimes."</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The commission noted the significant steps taken during India's decades-long efforts to restrict the use of the death penalty: removal of the requirement of giving special reasons for awarding life imprisonment instead of death (1955); introduction of the requirement of imposing the death penalty (1973); and the Supreme Court's decision that the death penalty should be restricted to the rarest of rare cases (1980). The conclusion reached by the commission was:</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"Informed also by the expanded and deepened contents and horizons of the right to life and strengthened due process requirements in the interactions between the state and the individual, prevailing standards of constitutional morality and human dignity, the commission feels that time has come for India to move towards abolition of the death penalty."</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">During the latest debate in the UN General Assembly, however, India again voted against the resolution calling for a moratorium although it could have shown some respect for the Law Commission's recommendation by abstaining. In two years, Pakistan has carried out 419 executions. 419 death row prisoners wore a hood as six warders accompanied them to the scaffold each time. 419 bodies remained suspended for 30 minutes after being hanged. Some of these bodies likely ended up in prison graveyards, unable to break free from jails even in death.</b></div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">On December 17, 2014, Pakistan lifted the moratorium on the death penalty in the wake of the tragic terrorist attack on the Army Public School in Peshawar. Originally lifted for terrorism related offences in March 2015, the moratorium was lifted for all capital offences. In the face of international opposition, the government has consistently maintained that the death penalty is the only effective means of fighting terrorism.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">However, an analysis of the 419 executions that have occurred in less than 2 years by Justice Project Pakistan (JPP), a rights group, reveals significant flaws in this narrative. In Pakistan, criminal culpability is at best, widely misunderstood and at worst, casually measured with irreversible consequences. The numbers that confirm this are frightening.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">27 offences are liable for a black warrant in this country, explaining the macabre achievement of having one of the world’s most populated death rows.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The 100th prisoner to be hanged after executions resumed was mentally ill, unaware until his death as to why he was being punished. Undiagnosed until 2014, Muneer Hussain was mentally unwell since childhood and later, killed two family members.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">There have been at least six juveniles executed since the moratorium was lifted in December 2014. Between then and March 2016, at least 444 mercy petitions were sent to the President of Pakistan, including one for schizophrenic prisoner, Imdad Ali and Abdul Basit who is a paraplegic prisoner. So far, the known number of presidential pardons granted stands at zero.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">In Pakistan, the judicial system that enables the carrying out of death sentences warrants close examination. The legal infrastructure is faulty, mired in red tape, beholden to power, creating a permissive environment for the routine miscarriage of justice.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">In November this year, the Supreme Court exercised its suo moto right to reassess a case of kidnapping in Bahawalpur in Punjab, for which two brothers had been sentenced to death. Unsurprisingly, the prosecution’s case was riddled with contradictions, with insufficient evidence and incongruous eyewitness testimonies, and the SC acquitted the condemned prisoners. Only Ghulam Qadir and Ghulam Sarwar were no longer prisoners, having been executed last year.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Given the Bahawalpur case, it is critical to overhaul a system that hangs the living, and exonerates the dead. The dearth of resources for law-enforcement incentivises corruption and other abuses of authority. Police lack forensic capabilities and other reliable means of investigation. As a result, there is over-reliance on confessions, easily obtained through torture.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">1,424 cases of torture have been uncovered in just one district of Faisalabad from 2006 to 2012, according to Justice Project Pakistan</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">444 mercy petitions have been sent to the president between Dec 2014 and March 2016; none have been granted so far</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">JPP uncovered 1,424 cases of torture in just one district of Faisalabad from 2006 to 2012. At 17, Abd-ur-Rehman was subject to such brutal torture following his detention that he admitted to every accusation levied at him, including being told that his name was Azam. Today, no one in Karachi Central Jail, where he remains imprisoned, knows him by the name he was born with. His involvement in an attempted burglary has kept him on death row for the last 18 years — well over half his life.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Every defendant is entitled to effective legal counsel at all stages of proceedings under the provisions of the International Covenant on Civil and Political Rights, to which Pakistan is a signatory. Though Pakistan provides needy capital defendants with counsel at state expense, the quality of representation is poor. In fact, it is generally not perceived as acceptable for lawyers to be seen in a jail.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Such scant contact between lawyers and their clients in criminal cases actively enables the miscarriage of justice, given the former essentially forgoes the chances of uncovering potentially exculpatory evidence. But with a fee below the minimum wage (a minimum of Rs2,000, with a daily fee of Rs200), there is little motivation for a state-appointed attorney to pursue a case.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">International law dictates that capital punishment be reserved only for the most serious crimes, subject to fair and legitimate processes that protect a defendant’s basic rights and provide avenues for post-conviction relief. Pakistan has not lived up to its obligations. At each stage of a defendant’s encounter with this system, severe violations emerge.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Calling for anything short of a complete moratorium on executions means the continued killing of individuals whose rights have repeatedly been violated from the time of their arrest to their conviction and beyond. Sending even one innocent person – and the government sent two in the Bahawalpur case – to the gallows should prompt this step.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Given these systemic failings, legal reforms, while an important first step, are inadequately implemented at the local level. An executive mechanism to examine mercy petitions must be assembled which refers credible mercy petitions to the presidency.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Because of the lack of transparency, it is recommended that independent actors such as the National Human Rights Commission, a statutory body constituted under the National Human Rights Commission Act 2012, conduct investigations into cases.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Wrongful and unjust death sentences must be commuted. Because the death sentence warrants a high standard of proof, the state should also commute cases for individuals whose convictions were based primarily on confessions, in recognition of the high prevalence of custodial torture and inadequate safeguards in place.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Passing the Anti-Torture Bill, which has been pending since 2012, would be a good place to start. The death penalty is not a large numerical issue in Montana, since, thank God, we have few on “death row.”</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">It is, however, big to the few and to our moral/ethical conscience. The death penalty is on legal “hold” in Montana, as uncertainty about drugs for lethal injection has become and continues to be an issue.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The moral/ethical position against capital punishment: Abolish the death penalty because it is the right thing to do.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">• “Thou shalt not kill.” We need to put this into action related to violence worldwide. In few instances do we have the power to control killing, but abolition of capital punishment is one such instance.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">• Mistakes are made in some cases. Infrequently, persons, who are later shown to be innocent, have been on death row awaiting execution. Some have, no doubt, been executed and later been proven innocent.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">• Family and loved ones of victims often favor life imprisonment over death and find solace in mercy.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">• The death penalty has not been a deterrent to crime, nor is there evidence that its abolition promotes or facilitates crime.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">• Is the person convicted and sentenced the same person who awaits execution, often many years after sentencing? Or has that person changed? It’s a privilege given humankind to be able to change.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">• Spare the executioner the experience of executing. Imagine such a job.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Another position: Abolish the death penalty because it’s the responsible thing to do.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">It costs society more to carry out a death penalty sentence than to maintain a life sentence, in terms of monetary costs of appeals, etc. Anti-death penalty legislation proposes life in prison without possibility of parole. It would cost less.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Lethal injection is not the merciful means of killing envisioned. About 7 percent of such executions are “botched.” The availability of drugs used to kill has been an issue for some time, and recently the pharmaceutical company Pfizer refused to provide its drugs for lethal injection. This makes a statement.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Not unexpectedly, there are pros and cons about these points, but we have chosen the position that suits our individual moral consciences. In some places, it's almost nonexistent. In Dallas and Harris counties, not a single death sentence was handed down this year.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">This is good news.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Executions are costly. Their value in deterring would-be murderers and others from committing their crimes is small. And they are disproportionately carried out against persons of color. Of the nine men sentenced to death in Dallas or Tarrant counties since 2012, all are African-American. In Harris County, 15 of the 18 more recent death sentences have been handed down against black defendants, the other three against Latinos.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Worst of all, an execution is the outcome of an error-prone system, and one that simply can't be undone once carried out.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">That insight was at the heart of the ruling 45 years ago next year in which the U.S. Supreme Court ruled 5-4 that the death penalty violated the Constitution.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"The penalty of death differs from all other forms of criminal punishment, not in degree but in kind," Justice Potter Stewart wrote in one of five concurring opinions in Furman vs. Georgia. "It is unique in its total irrevocability. It is unique in its rejection of rehabilitation of the convict as a basic purpose of criminal justice."</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Four years later, the court ruled that with proper attention to racial fairness and other factors, the executions could resume. But ever since, Texas has had a starring role in demonstrating just how naive that second decision was.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">It's distressing to note that support for the death penalty remains strong in many states, including Texas (<a href="http://www.pewresearch.org/fact-tank/2016/09/29/support-for-death-penalty-lowest-in-more-than-four-decades/" target="_blank">though that support is at its lowest level in decades</a>). There is hope in the<a href="http://www.dallasnews.com/opinion/editorials/2015/12/30/editorial-could-texas-be-losing-its-appetite-for-the-death-penalty" target="_blank"> fact that actual use of the death penalty is fading fast. </a></div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">In the past five years, 26 inmates on Texas' death row have been removed. Eighteen saw their sentences reduced. Seven died in custody. One was exonerated and released.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Even Texas' famously tough-on-crime Court of Criminal Appeals has grown far more careful when it comes to executions. In the past two years, the court has issued a total of 15 stays of execution. We need more reform to avoid wrongful convictions. Without reforms, the poor will again bear the consequence of the weakness and inconsistency in the application of the criminal justice system," the lawmaker said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">According to Baguilat, the plan to railroad passage of the death penalty is a grave cause for concern considering that it had already been established that imposing the capital punishment would not deter proliferation of crime.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"We need to strengthen [the justice system]first to make a more lasting impact on criminality. I have never believed in legislating this ultimate retribution," he said, adding that there is no credible data showing that the death penalty is a crime deterrent.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"That is why I am again appealing to my colleagues in Congress to not rush into passing such a bill and instead allow extensive and intelligent discussion," Baguilat said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Apparently as part of the campaign against illegal drugs and criminality, the House majority led by House Speaker Pantaleon Alvarez remained resolute in immediately passing a law that will bring back the death penalty.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">President Rodrigo Duterte has consistently said that he wanted the death penalty law as part of the package of measures to stop the proliferation of drugs and criminality.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"I have always said that I am supportive of the President's campaign against drugs and criminality. People respond to the death penalty with this very highly emotional response," he added.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">According to Conde, the death penalty is a very popular issue because of President Rodrigo Duterte.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"This push for the death penalty arises from the popularity of President Rodrigo Duterte; so as long as he's extremely popular, we expect politicians and lawmakers to follow his lead," he said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Conde admitted that it will be difficult for those who are against death penalty to convince pro-death penalty lawmakers.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"If there is enough groundswell of dissent against these death penalty proposals in Congress, certainly all those people who did not vote for President Duterte could make a dent in the argument against death penalty, but you know, the death penalty is not a very popular issue among advocates," he said. For us, it is the biggest weapon now for crime prevention, deterrence. When it comes to data, pro-life is saying that it is not a deterrent. Fredenil Castro yesterday said the discussions on the bill to reinstate death penalty, a priority legislative measure of President Duterte, will be moved to early next year, so that congressmen would have a thorough plenary debate.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">In a radio interview, Castro said he was responsible for moving back the bill's discussion on the floor because he wanted to prepare to defend it at the plenary.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Castro is one of the principal authors of House Bill No. 1, which seeks to reimpose capital punishment for heinous crimes after it was abolished by then President and now Pampanga Rep. Baguilat had said the plan to railroad the passage of the death penalty was a grave cause for concern considering that it had already been established that having a death penalty would not deter the proliferation of crime. "It is not a deterrent. There is no reliable and credible data to show that it is," said Baguilat. "That is why I am again appealing to my colleagues in Congress to not rush into passing such a bill and instead allow extensive and intelligent discussion."</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The Cordilleran lawmaker also said the better move is to strengthen the justice system to make sure that justice is served quickly and that the real criminals will go to jail.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"As it is, everybody is saying that the justice system is flawed. That means what we need is more reform to avoid wrongful convictions. Without reforms, what will happen is that the poor will again bear the consequence of the weakness and inconsistency in the application of the criminal justice system. I have never believed in legislating this ultimate retribution," Baguilat said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Capital punishment was last suspended in 2006 by President Gloria Macapagal-Arroyo. At that time, Congress was overwhelmingly supportive of the tenet that life has value. Vast majority of the 426 executions carried out since the moratorium was ended for the death penalty in December 2014 has been for crimes unrelated to terrorism.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">There is an ideological debate on the issue of execution in the country as one side believes the death penalty serve the purpose of deterrent against crimes. The other side claims that execution can never be a deterrent against the crimes and this could be justified through the crime data of western countries where execution is banned.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The legal and constitutional experts also believe there are legal shortcomings and serious problems in the criminal justice system. Therefore, they say under these circumstances the extreme punishment is unjustified and illegal.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Syed Nayyar Abbas Kazmi was one of person executed after the moratorium was ended for the death penalty. His number was 182 on the list of those who executed in year 2015 and was hanged on July 29, 2015 in Multan jail. He was charged in murder case and arrested in 1996. According to his family, they were in negotiation with the victim's family for settlement but before they reached any agreement he was hanged.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Talking to The News, Syed Naeem Abbas Kazmi brother of Syed Nayyar Abbas, a resident of a small village Kotla Haji Shah (Layyah), said he was 18 when he was jailed and spent 19 years in the jail.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"We tried a lot for settlement and were paying the blood money to the bereaved family. Initially they did not agree for the settlement but when he (Nayyar) spent more than 1/2 of his life in jail they agreed for the talks. We were almost in the middle of the negotiation but before we reached an agreement he (Nayyar) was hanged", commented Naeem Shah.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Soon after the terrorists attack on Army Public School Peshawar in December 2014, Prime Minister Nawaz Sharif addressed the nation and announced a 20-point National Action Plan (NAP) whereof executing the terrorists was the 1st point.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">In 2014, 7 people were hanged. All of them were executed on terrorism charges. 3 of them were involved in attack on General Musharraf. Dr Usman, the mastermind of GHQ attack and 3 other persons were accused of suicide attack on Musharraf's convoy.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Similarly, 333 people were hanged in 2015, out of which 15 were executed on the charges of terrorism whereas the remaining 318 were hanged on murder charges. 3 out of the 15 have been hanged on the charges of attack on Musharraf. 3 have been charged for highjacking PIA plane whereas 4 people have been hanged on the charges of attack on Army Public School Peshawar.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">From January to November 2016, total 86 people have been executed, out of which total 7 were hanged on the charges of terrorism. More than 90 % of the execution occurred in jails of Punjab province. According to the data obtained from Justice Project Pakistan, a local NGO, 46 persons have been hanged in Faisalabad,39 in Rawalpindi, 52 in Lahore, 10 in Karachi, 25 in Multan, 31 in Sahiwal, 33 in Bahawalpur, 4 in Mirpur, 9 in Jhang, 2 in Peshawar, 6 in Jahlum, 7 in Harripur, 5 in Sukkur, 1 in Larkana, 14 in Gujranwala, 13 in Sargodha, 19 in Attock, 6 in Toba Tek Singh, 17 in Mianwali, 7 in Mach, 16 in Gujrat, 9 in Vehari, 17 in Sialkot, 2 in Haiderabad, 9 in DG Khan, 6 in Kasur, 11 in Kohat and one in Teemer Graha.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Chairman Pakistan Muslim League-Nawaz (PML-N) and Leader of the House in Senate, Senator Raja Zafarul Haq, while commenting on the execution says, Islam teaches to avoid awarding death penalty at first place and it should be applied as a last resort.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"Sometimes perceptions and human errors cause to make mistakes therefore awarding death penalty should be avoided. This is such an extreme punishment which cannot be overturned so easily keeping our criminal and justice system in view. We have seen many cases when people are wrongly executed. Because of having no influence and lack of resources they could not challenge the verdict at the level of apex courts. This is the reason Islam has asked to avoid awarding extreme punishment as 1st choice," Raja Zafarul Haq remarked.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"Though there is a proper system of punishments for any crime in Islam but these penalties are used as last resort. For instance there are 12 or 13 precautions which needed to be checked before awarding sentence of cutting hand of a thief. Similarly death penalty is even the extreme punishment which should be avoided unless it is necessary. There are many other ways to control the crimes and bring reforms in the society. The punishment should be awarded keeping justice system and course of evidence in view", he commented.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"We need to review the capital punishment law and bring changes in it accordingly keeping our criminal justice system in view," recommended Raja Zafarul Haq.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Analysis of the official data of Lahore High Court for the year 2014 shows that total 1105 execution petitions were instituted across the province whereas 458 petitions were pending from the previous years. The courts disposed of 988 (63 %) execution petitions whereas 575 (37 %) remained pending for the next year.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Similarly, the same year 1456 new cases were instituted in anti-terrorism courts whereas 380 cases were pending from the previous years. The courts disposed of 1400 (76 %) cases whereas 436 (24 %) cases remained undecided.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">According to the Justice Project Pakistan's data, after China and Iran, Pakistan has become the 3rd ranking country in terms of executing people. In 2016, there is no exact data of executions in China, but 57 people hanged in Iran whereas Pakistan has executed 86 and Kingdom of Saudi Arabia 93.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The data further shows that till 2013, Pakistan has the largest death row population in the world as total 8,568 were waiting for death penalties. According to JPP's data, total 800 prisoners on death row in Pakistan were tried as 'terrorists'. In 86% of these cases, there was no link to anything reasonably defined as 'terrorism'. Hence, the 'terrorism' cases represent more than 1 in 10 of Pakistan's death row in the figures from 2012. However, this is now estimated to be as high as 30% whereas in the province of Sindh the figure is as much as 40 %. It is pertinent to mention here that there are currently over 17,000 pending 'terrorism' cases in Pakistan</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Barrister Sarah Belal, director Justice Project Pakistan (JPP) believes executions can never serve as deterrent against crimes. This could be justified while analyzing the crime data of entire world as crime has no relation with hanging someone.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">"Our criminal justice system is full of problems. We have problems in investigation system; there is capacity problem in our police department whereas bribery and political pressures further add to the miseries of the people. How can we execute a person when the criminal justice system is problematic? Therefore first we need to take measures to improve the system and then think about executing the criminals", commented Barrister Sarah.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The government officials on the other hand have a totally different perspective on the death penalty. They claim that policy of execution has proven effective as deterrence against terrorism. According to the official statistics the number of terrorist attacks has decreased from 1,823 in 2014 to 1,009 in 2015. Fatalities from attacks have also decreased from 1,761 in 2014 to 1,081 in 2015.</div><div style="text-align: justify;"><br /></div>Source: The News, December 14, 2016<br /><br /><h2>Death penalty: LHC rejects appeals of 7 military court convicts</h2><br /><div style="text-align: justify;">The Lahore High Court dismissed on Tuesday the appeals of 7 militants convicted by military courts in cases of targeted killings.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">An LHC division bench comprising Justices Shahid Mahmood Abbasi and Shahid Mehmood Sethi dismissed the writ petitions of the 7 convicts associated with proscribed organisations after going through the record of the military court's proceedings and arguments presented in-camera by the federal government.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The military courts had awarded death penalty to Sabir Shah, Abdul Rauf, Awais Gujjar, Suleman Pathan, Rafiullah and Sheikh Farhan, but the heirs of the convicts challenged their sentences before the high court.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">On behalf of the appellants, Advocate Ali Zia Bajwa argued the trial of the convicts was under way in anti-terrorism courts when their cases were shifted to the military authorities from Kot Lakhpat jail. Neither the convicts were allowed to meet their families nor given a chance to engage a counsel to defend themselves before the military courts, he added.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The counsel contended the families of the convicts only come to know about the military courts' decision through a press release issued by the military's media cell. Paulus Christian Siswantoko, executive secretary of the Commission for Justice, Peace and Pastoral Care of Migrants of the Catholic Bishops' Conference of Indonesia, the letter sent to the executive states that "it is appropriate for the government to carefully assess the implementation of the death penalty in order to know the impact of capital punishment, and to ensure that executions have actually had the deterrent effects, discouraging crime". In an interview with Agenzia Fides, Fr. Siswantoko reiterated that the Catholic Church has repeatedly asked for a moratorium "but so far the government has not listened to the voices who reject capital punishment".</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">At a recent conference on the theme "Right to life and the death penalty in the theology of religions", Fr. Siswantoko said that "the Catholic Church still harbors hopes for a moratorium on the death penalty", citing religious but also civilian reasons.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">In fact, according to the priest, Catholics reject the death penalty for the fundamental respect for life, as explained by the encyclical Evangelium Vitae of 1995, of Pope John Paul II. On the other hand "the death penalty is contrary to the Pancasila (the paper of the five underlying principles of the state, ed) and to the Indonesian Constitution, claiming the protection of life and fundamental human rights". "It was later shown that the death penalty does not reduce crime", he said.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Since 2015 dozens of prisoners for drug offenses have been executed in Indonesia: "Has there been a significant impact and real deterrent effects?" asked the priest, noting that the spread and drug trafficking is a phenomenon at a national and international level.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Among the other speakers who intervened, Gomar Gultom, representative of the "Communion of Churches in Indonesia" confirmed the vision that "the death penalty has no deterrent effect and it is not an ethical tool". </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Muslim professor Siti Musdah Mulia, at the Islamic University "Syarif Hidayatullah" and secretary general of the Indonesian Conference on "Religions for Peace" recalled that Islam teaches human respect and protection from acts of discrimination, exploitation and violence. "The death penalty is inconsistent with religious teachings and faiths that revere the importance of life, preserving it as the greatest blessing of God the Creator. Islam teaches the dignity of human beings, defining them as the most perfect creatures of God. The death penalty is an affront to the greatness and omnipotence of God.
